Terms of Service

These Terms of Service ("Terms") govern your use of the Zeitclaim web application at zeitclaim.com (the "Service"), operated by Stefan Joschko - van Ackern ("we", "us", "our").

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

1. What Zeitclaim Is

Zeitclaim is a web application that helps freelancers track their working time. You log activities using an AI-assisted chat interface (including voice input), and the app organizes your time entries by project and category.

Zeitclaim is a time tracking tool — it does not provide financial, legal, or tax advice. You are responsible for verifying all data before using it for any business or reporting purpose.

2. Account Registration

To use the Service, you must create an account and provide accurate information. You are responsible for:

• Keeping your login credentials secure.
• All activity that occurs under your account.
• Notifying us immediately if you suspect unauthorized access.

You must be at least 18 years old to use the Service.

3. Acceptable Use

You may use the Service for its intended purpose of tracking your working time. You agree not to:

• Use the Service for any illegal activity.
• Attempt to access other users' accounts or data.
• Interfere with or disrupt the Service.
• Reverse engineer, copy, or create derivative works of the Service.
• Enter sensitive personal data of third parties (e.g., health data, financial data of others) into the Service. Zeitclaim is not designed to process special category data under GDPR Art. 9.

4. Intellectual Property

Our IP: The Service, its design, code, and branding are owned by us. All rights reserved.

Your data: You retain full ownership of all data you enter into the Service (activity entries, categories, projects, chat messages, rules). We claim no intellectual property rights over your content.

License you grant us: By using the Service, you grant us a limited, non-exclusive license to process your data solely for the purpose of providing and maintaining the Service. We will not use your data for any other purpose.

5. Paid Plans and Billing

Pricing

Current pricing is listed on our website at zeitclaim.com/#pricing.

Free Trial

New accounts receive a free trial with full access to all features, for the duration advertised on our website. No credit card is required for the trial.

After the Trial

If you do not subscribe after the trial, your account switches to read-only mode: you can view your existing data, but AI features and new activity logging are disabled. Your data is not deleted.

Payment Processing

All payments are processed by Paddle (Paddle Payments Limited, Dublin, Ireland), our Merchant of Record (MoR). Paddle is the legal seller — they handle payment card processing, invoicing, VAT, and tax compliance on your purchase. We never see or store your payment card details.

Subscriptions automatically renew at the end of each billing period (monthly or yearly, depending on your plan) until you cancel.

Available payment methods are determined by Paddle.

Cancellation

You can cancel your subscription at any time through the Paddle customer portal, accessible from your billing settings in the app. After cancellation, you retain full access until the end of your current billing period. After that, your account switches to read-only mode.

Refunds and Right of Withdrawal

If you are not satisfied with the Service, we will issue a refund for your first purchase within 30 days of that purchase. Subsequent purchases are not eligible for refunds. Refunds are processed by Paddle as Merchant of Record.

Price Changes

We grandfather existing customers: if we increase prices, the change only applies to new subscriptions. Your price stays the same as long as your subscription remains active.

If we ever need to change prices for existing customers in the future, we will provide at least 30 days advance notice.

6. AI-Parsed Content

The AI assistant in Zeitclaim parses your natural language input and automatically saves structured activity entries. These entries are generated by a large language model.

Important:

• AI-parsed entries are saved automatically. You are responsible for reviewing your logged entries and correcting any inaccuracies — AI will make mistakes.
• We are not responsible for errors in AI-parsed content.
• Activity entries are time tracking records only. No legally binding decisions are made on your behalf by the AI.

7. Service Availability

We strive to keep Zeitclaim available and reliable, but we do not guarantee uninterrupted access. The Service is provided on an "as is" and "as available" basis.

We may perform maintenance, updates, or experience downtime. We will try to notify you of planned disruptions in advance when possible.

We do not offer a Service Level Agreement (SLA).

8. Data After Account Closure

If you cancel your subscription, your data remains accessible in read-only mode indefinitely — you can return and resubscribe at any time. Accounts in read-only mode that have had no activity for more than 3 years may be deleted after 30 days' notice to your registered email address.

If you request account deletion (via email to info@zeitclaim.com), we will delete all your personal data within 30 days. Some data may persist in backups for a limited period before being permanently removed.

9. Limitation of Liability

To the extent permitted by German law:

• We are fully liable for damages caused by intent or gross negligence, and for injury to life, body, or health.
• For breaches of material contractual obligations (Kardinalpflichten), our liability for slight negligence is limited to foreseeable, contract-typical damages.
• We are not liable for indirect, incidental, or consequential damages, loss of data, lost profits, or business interruption, except where mandatory law provides otherwise.
• Our total liability for contract-typical damages is limited to the fees you have paid us in the 12 months preceding the claim.

Nothing in these Terms limits liability that cannot be excluded or limited under applicable law, including under German consumer protection law.

10. Termination

By you: You may stop using the Service and request account deletion at any time by emailing info@zeitclaim.com.

By us: We may suspend or terminate your account if you violate these Terms, with notice where practicable. In case of serious violations, we may terminate without prior notice.

Upon termination, your right to use the Service ends. We will handle your data as described in section 8.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect, via email or a notice in the Service.

If you continue to use the Service after the changes take effect, you accept the updated Terms. If you do not agree, you may cancel your account before the changes take effect.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany.

Jurisdiction: Essen, Germany, to the extent permitted by law. If you are a consumer within the EU, you may also bring claims in the courts of your country of residence, in accordance with applicable EU consumer protection law.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.

14. Privacy

Our Privacy Policy explains how we collect, use, and protect your personal data. It forms part of these Terms.
